TERMS AND CONDITIONS OF SALE BUFFALO LEATHER REPAIR AND CARE LTD
1 DEFINITION
"Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;
"Consumer" shall have the meaning as described in section 12 of the Unfair Contract Terms Act 1977;
"Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
"Goods" means the articles that the Buyer agrees to buy from the Seller;
"Seller" means, Buffalo Leather Repair and Care Ltd, Unit 2C Hillthorpe Farm, Knoll Lane, Little Hoole, Preston, Lancashire, PR4 4TB who owns and operates handmadebybuffalo.co.uk
"Terms and Conditions" means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller;
"Website" handmadebybuffalo.co.uk
2. PRODUCT SPECIFICATIONS
2a) Goods supplied may differ slightly in colour tone from those advertised online due to consumer's computer monitor settings or differing fabric and leather batches.
2b) Leather will have natural marks such as healed scars which signify genuine leather. Leather goods are natural and may not be uniform in colour, finish or texture; it is common place and part of the authenticity of real leather. You are accepting that such characteristics are not regarded as defects in assessing whether or not the goods are of satisfactory quality. Some leathers will naturally fade and mature with age with exposure to sunlight or heat.
2c) We will endeavour to match the colour and texture of the fabric of your sofa to the samples chosen as accurately as possible, but variations in both the colour and texture may occur from batch to batch.
2d) The measurements of furniture will be as accurate as possible but are approximate as the items are handmade and may vary slightly; the buyer agrees to ensure that they allow more adequate space than the measurements given.
3. ORDERING
3a) All orders for Goods shall be deemed as an offer by the buyer to purchase goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
3b) If the Goods ordered by the Buyer are not available to the buyer within 6-8 weeks the buyer will be notified and given the option to either wait until the goods are available or cancel the order and receive a full refund within 7 working days.
3c) When making an order via the telephone a 50% deposit will be taken with balance due when a delivery date is confirmed between the buyer and seller. The deposit is non-returnable should the seller change their mind and cancel the purchase of goods.
4 PRICE AND PAYMENT 4a) The price of the Goods shall be that stipulated on the Website. The price is inclusive of VAT. The price includes delivery charges unless otherwise stated regarding remote postcode areas.
4b) The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyer's shopping cart prior to confirming the order, or as confirmed verbally to the buyer and as set out in a conformation sales invoice.
4c) After the order is received the seller shall confirm by email the details, description and price of the goods.
4d) Payment of the price inclusive of VAT and delivery charges must be made in full at the time of arrangement of dispatch of the Goods.
4e) Title in the Goods shall not pass to the Buyer until payment of the price has been made in full.
7. DELIVERY 7a) All orders for delivery to addresses within mainland UK are delivered free of charge, except for remote postcodes where a charge will be discussed with the buyer and added to the final cost of the order.
7b) Where an order contains more than one item, all items will be delivered at the same time when all items are available. Should the Buyer request a part delivery, the Seller reserves the right to take payment of an additional delivery charge not usually exceeding £85.00
7c) Goods supplied to mainland UK will normally be delivered from stock within 4-8 weeks depending on location, or within the time submitted at the acceptance of order for bespoke goods manufactured to your specific. When a specific delivery date has been agreed, and where this date cannot be met, the Buyer will be notified and given the opportunity to agree an alternative delivery date.
7d) The Seller shall use reasonable efforts to meet any date agreed for delivery. In any event if the date of delivery cannot not be made the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
7e) Delivery of the Goods shall be made to the Buyer's external entrance of the address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. The Seller and the delivery company will not be liable for any damage to any internal fittings and fixtures, once the goods have entered the Buyer's address.
7f) Risk in the Goods shall pass to the Buyer upon delivery of the Goods.
7g) If you are unable, for whatever reason, to take delivery of your Goods on the confirmed delivery date, we reserve the right to charge you a minimum of £85 for any subsequent deliveries.
8 CANCELLATIONS AND RETURN
8a) The Buyer may cancel the order in writing or via email for any reason within 14 days. Any payments made by the Buyer shall be refunded in full within 7 working days following collection of Goods.
8b) The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller in writing or via email within 14 days if for whatever reason the Goods are not satisfactory or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.
8c) Should the buyer after accepting delivery wish to cancel the order with 14 days of delivery of goods the goods must be returned in the condition they were delivered. Where returned Goods are found to be damaged due to the Buyer's fault the Buyer will be liable for the cost of remedying such damage.
8d) Where a claim of defect or damage is made by the buyer to the Seller, the seller will be responsible for the collection of Goods from the Buyer within 30 days of delivery. The Buyer shall be entitled to a replacement or a full refund (including delivery costs) if the Goods are in fact defective.
8e) The Seller is not responsible for any discolouration or fading of leather or fabric colour.
9 LIMITATION OF LIABILITY
9a) Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which will in no circumstances exceed the agreed selling price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage.
9b) Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller's agents or employees.
10 OCCURRENCES BEYOND THE REASONABLE CONTROL The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.
11. GOVERNING LAW AND JURISDICTION These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
